Dealer stock register in Tasmania: what traders must record
We couldn’t find a dealings book or stock register requirement in the Tasmanian Motor Vehicle Traders Act 2011 or the Motor Vehicle Traders Regulations 2022. Tasmanian traders still have to record set vehicle details on the pre-sale disclosure statement and transfer documents, and search for encumbrances before buying or taking a car on consignment.
- No dealings book requirement found in the Act or Regulations; confirm with Consumer Affairs Tasmania.
- The pre-sale disclosure statement records make, model, rego, VIN and the odometer when you acquired the car.
- Record the odometer reading on the transfer documents at the time of sale or exchange.
- Search the securities register before buying, accepting on consignment or taking a trade-in.
Which law applies
Traders are licensed under the Motor Vehicle Traders Act 2011, with the Motor Vehicle Traders Regulations 2022 covering licence exemptions, the pre-sale disclosure statement, fees and infringement offences. The regulator is Consumer, Building and Occupational Services (CBOS), through the Office of Consumer Affairs and Fair Trading; some of its material now appears on the Consumer Affairs Tasmania website.
Is there a stock register in Tasmania?
The register the Act talks about is the Director’s public register of trader licences, not a dealer’s stock book. We couldn’t confirm a separate dealer register requirement, so check with Consumer Affairs Tasmania. Keeping one anyway gives you the records the rules below need in one place.
What you do have to record
| Record | What goes in it |
|---|---|
| Pre-sale disclosure statement | Vehicle details including make, model, registration, VIN and the odometer reading at the time you acquired it. Displayed on used vehicles and included in the contract. |
| Transfer documents | The odometer reading at the time of sale or exchange |
| Encumbrance search | A search of the securities register before you buy, accept on consignment or take a trade-in |
Consignment
Before accepting a car on consignment you must search the securities register to see whether an encumbrance is registered. For any other consignment records, check with Consumer Affairs Tasmania.
Electronic records, retention, inspection and penalties
Because we couldn’t confirm a register requirement, we also couldn’t confirm rules on electronic records, retention, inspection or penalties for one. Check with Consumer Affairs Tasmania. Licensing is covered in our TAS car dealer licence guide.
