The rules, state by state

Printed on the contract, automatically

In carassessments.com.au the warranty class is worked out from the car’s age and kilometres on the stock card and printed on the contract of sale, so nobody has to remember the thresholds. See compliance and paperwork.

How dealer warranties compare across Australia, and how they sit alongside the consumer guarantees: statutory warranty by state.

Questions dealers ask

What is a statutory warranty on a used car?

A warranty some states require licensed dealers to give on used cars that meet age and odometer limits. The dealer must repair defects that appear during the warranty period at no cost to the buyer. It sits on top of the Australian Consumer Law guarantees, which apply in every state.

Does statutory warranty apply to private sales?

No. Statutory dealer warranties apply to sales by licensed dealers. Private sellers don’t give one, which is one reason buyers pay more at a dealer.

Can a buyer waive the statutory warranty?

In most states the warranty can’t be excluded by the contract. Some states have narrow exceptions, so check your state’s guide before relying on a waiver.

Does it apply to consignment sales?

It depends on the state and how the sale is made. See the consignment notes in your state’s statutory warranty guide.
